What is Sealing?

If you entered a plea to a qualifying offense, you may be eligible to have your case sealed.  

Sealing your case means that the case file will be removed from public view (meaning an online clerk of court record search will come back empty) and someone would need a court order to access your actual file.  

If you are able to successfully seal a case, you may even be able to lawfully deny you were ever arrested/charged with a crime in the future (subject to a few exceptions).

What is Expungement?

When a record is expunged, your actual case file is destroyed.  In order to be eligible for an expungement, your case needs to have been dismissed by the prosecutor or court. Even though your case file is destroyed, The Florida Department of Law Enforcement will still retain a copy of your criminal history.  Nonetheless, subject to a few exceptions, you will be able to deny any involvement with the case in the future.

No one public entity has access to your criminal history. However, the Florida Department of Law Enforcement has the authority to disclose the existence, yet not the specifics, of your expunged history if you apply for employment, membership or a license with one of these agencies:

· A criminal justice agency

· Florida Bar

· Department of Children and Family Services

· The Department of Juvenile Justice

· A contractor or licensee in a sensitive position having direct contact with children

· The Department of Education

· Any public or private school

· A local government agency that licenses child care facilities


Right to Renounce and its Limitations

Once we have obtained your expungement, you can disavow or fail to admit the arrest or conviction that the expungement enumerates.
Be that as it may, there are caveats to the right to renounce that expunged case. These are the situations in which you must admit to an expunged case. If you are:

· A candidate for employment with a criminal justice agency

· A defendant in a criminal prosecution

· Concurrently or subsequently petitioning to have another unrelated criminal episode sealed or expunged

· A candidate for admission to the Florida Bar

· Seeking to be employed, licensed by or contracted with:

· The Department of Children and Family Services

· The Department of Juvenile Justice

· Any position having direct contact with children

· The Department of Education

· Any public or private school

· Any local government agency that licenses child care facilities
